Man accused of murdering pensioner Frank Kinnis near Elgin deemed unfit to stand trial
The man accused of murdering an 83-year-old in woods near Elgin has been deemed unfit to stand trial.
David Johnstone (35) was due to appear in the dock when his case was called this morning at the High Court in Glasgow.
However he was not well enough to travel from the State Hospital where he is being detained.
An examination of the facts will now take place on July 27 at the High Court in Edinburgh.
Judge Lord Arthurson ordered Johnstone to be detained in the meantime.
Frank Kinnis died after being attacked in Birkenhill Woods, near New Elgin, on October 21 last year.
It is alleged that Johnstone attacked Mr Kinnis as well as two 70-year-olds – Morris Smith and his wife Jan – on the same day.
He is further accused of assaulting two police officers.
